New York legalized e-bikes statewide in the April 2020 budget and asks for no license, no registration, and no insurance for Class 1, Class 2, or Class 3. Class 1 gives pedal assist up to 20 mph and Class 2 adds a throttle up to 20 mph, both legal statewide wherever bicycles are allowed. Class 3 is New York's twist: a throttle-capable e-bike up to 25 mph, legal solely within a city of one million or more, which means New York City; everywhere else it is not a street-legal e-bike.

Every rider must be at least 16 to operate any class, and all Class 3 riders wear a helmet regardless of age, while adult Class 1 and Class 2 riders face no statewide mandate. E-bikes ride on highways posted 30 mph or less and in bike lanes statewide, while sidewalks are off-limits unless a local law expressly permits it. In New York City, a citywide DOT rule has capped e-bikes at 15 mph on streets, bike lanes, and park paths since October 24, 2025. New York legalized e-bikes statewide in the April 2020 budget and runs a three-class system with one twist: Class 3 is a 25 mph throttle class legal only in New York City. No license, no registration, no insurance — but every rider must be 16.

The motor assists only while pedaling and cuts off at 20 mph; legal statewide wherever bicycles are allowed.

Class 2

Throttle + pedal assist

The throttle may propel the bike without pedaling, up to 20 mph, statewide.

Class 3

New York's unusual Class 3: a throttle-capable e-bike up to 25 mph, legal solely within a city of one million or more — New York City.

Driver license
Not required

No driver license is needed for any class of e-bike in New York (VTL Article 34-C).

Registration
Not required

Compliant e-bikes under VTL 102-c cannot be registered with the DMV and carry no plates.

Insurance
Not required

New York imposes no insurance mandate on any e-bike class — coverage is the rider's choice.

Minimum age
16 years

Riders must be at least 16 to operate any e-bike class in New York.

Helmet
Class 3 riders

All Class 3 riders wear a helmet regardless of age (VTL 1238); no statewide mandate for adult Class 1 and Class 2 riders.
